If the Board deems it necessary to carry out any or all work related to the construction, maintenance, operation or management of railways by an organization of the private sector after taking the prior approval of the Government of Nepal, it may entrust the work to that organization by entering into an agreement with such organization in accordance with the prevailing law.
(2) When allowing work to be done in accordance with sub-section (1), any structure, equipment and property under the ownership or custody of the board related to that work may be given to such organization for use.
(3) When entering into an agreement in accordance with sub-section (1), the rights, enjoyment, ownership or use of structures, equipment and assets of the Board, the duration of the agreement, the remuneration to be received by the contracting party and other related matters shall be as mentioned in the agreement.
(4) Entering into a contract according to sub-section (1) - After the contract period expires, the organization shall return to the board the right, enjoyment, ownership or custody of any structure, equipment and property used by the board in accordance with the conditions specified in the contract.
(5) Other matters related to the construction, maintenance, operation and management of the railway shall be as mentioned in the contract.
